The post-pandemic surge in home working triggered a massive influx of garden rooms, outbuildings, and detached studios across the London Borough of Lambeth. While many homeowners assume building a timber box at the end of the garden is an automatic Permitted Development (PD) right, the rules are rigidly conditional. Lambeth actively hunts for structures that blur the boundary between "incidental use" and independent living.
A garden room is permitted; a separate dwelling is a criminal planning offense.
The 'Incidental Use' Perimeter
Lambeth regulates the scale and internal facilities of outbuildings to prevent the stealth creation of "beds in sheds":
- Strict Geometrical Caps: Under PD, garden rooms are capped at a maximum height of 2.5 metres (if within 2 metres of a boundary line). Given the narrow width of Lambeth gardens, nearly all outbuildings sit within 2 metres of a fence. The total footprint combined with any existing extensions must not exceed 50% of the original curtilage.
- The Bedroom Test: PD rights only apply if the outbuilding's use is "incidental to the enjoyment of the dwellinghouse" (e.g., a home gym, office, or art studio). If the drawings indicate a bedroom, the structure requires full planning permission. The addition of a fully fitted kitchen or a shower room elevates the suspicion of the council; they will likely demand a planning application to assess it as a "sub-divided operational dwelling."
- Front Garden Prohibition: It is absolute planning suicide in Lambeth to attempt building any form of substantial outbuilding (other than a very minor, compliant bin store) within the curtilage forward of the principal elevation (the front garden). Not only does it fail PD, but planners consistently refuse full applications for front garden structures on the grounds of "visual streetscape clutter."
