Transforming a soft front garden into a sterile, paved parking pad is one of the most contentious residential alterations in the London Borough of Lambeth. The council views the cumulative loss of front gardens as an ecological catastrophe, directly contributing to localized flash flooding (by eliminating soil absorption) and the visual degradation of historic residential streets.
Operating under the assumption that you can pave your entire frontage under Permitted Development (PD) is legally perilous.
The Permeability Mandate
To construct a new driveway (hardstanding) legally, you must adhere to rigid environmental constraints:
- The 5-Square-Metre Rule: Under PD, if you are paving an area larger than 5 square metres in your front garden, you must use permeable materials (such as porous asphalt, permeable block paving, or gravel systems) that allow rainwater to drain naturally into the earth beneath. If you pour a solid concrete or non-porous tarmac slab, it requires Full Planning Permission, which Lambeth will almost certainly refuse due to non-compliance with Sustainable Drainage Systems (SuDS) policy.
- The 50% Soft Landscaping Clause: Even when using permeable materials, Lambeth actively resists the complete eradication of greenery. Full planning applications proposing 100% hardstanding are routinely rejected for causing "severe harm to visual amenity." Planners mandate that you retain at least 50% of the front garden area for soft landscaping, mature planting, and biodiversity.
- The Dropped Kerb (Crossover) Checkmate: A driveway is functionally useless without a dropped kerb. Even if your permeable paving falls under PD, creating the dropped kerb requires separate consent from Lambeth’s Highways department. If your property is on a classified road (A, B, or C road), or if the new crossover would eliminate a vital public on-street parking bay, Highways will veto the application, leaving you with a costly, inaccessible paved garden.
