1. The Most Dangerous Assumption
The single most common argument our Planning Directorate hears from clients undertaking a Full Refurbishment in the London Borough of Hammersmith & Fulham (LBHF) is: "Why did they refuse my roof terrace? Number 42 down the street built the exact same thing five years ago!"
2. The Irrelevance of History
In the highly aggressive theatre of London planning law, "Precedent" is virtually worthless unless you understand context. If Number 42 secured planning permission for an ugly box dormer window in 1995, that does not mean you have the right to build one today. In 1995, the current, extremely rigid LBHF Local Plan did not exist.
3. The Ratchet Effect of Policy
Planning policy never becomes more relaxed; it only tightens. Particularly within Conservation Areas, the council explicitly uses new applications to stop the bleeding of heritage assets. When a client points to an ugly 1980s extension on the street, the Conservation Officer will reply: "That was a historical mistake. We will not compound that mistake by allowing you to replicate it."
4. The Danger of Illegal Precedents
Frequently, clients point to neighbors' massive rear extensions or basements to justify their own oversized ambitions. What the client doesn't realize is that the neighbor's extension was built completely illegally and slipped through the cracks. Using an illegal development as a planning precedent to justify your own application is a guaranteed route to a brutal refusal.
5. Deploying Precedent Correctly
To successfully use "Precedent," our Architecture team must find an almost identical property, on the exact same street, that won permission for the exact same design within the last 24 months under the exact same active LBHF Local Plan policies. That is the only scenario where the council can be reasonably legally bullied into maintaining consistency.
