1. The National Bypass Loophole
Many homeowners in the London Borough of Hammersmith & Fulham (LBHF) attempt to avoid the treacherous planning application process entirely by utilizing "Permitted Development Rights" (PDR). Granted by the national government, PDR allows you to execute specific, minor alterations (like small rear extensions or loft skylights) without ever asking the LBHF Planning Directorate for formal permission.
2. The Rigid Mathematical Boundaries
PDR is not a blank check for a Full Refurbishment. It operates on incredibly strict, non-negotiable geometric rules. If your proposed rear extension exceeds the national PDR height limit by a single centimeter, or you use a material that does not "match the existing" house, the entire project instantly falls out of PDR. It becomes illegal development liable to Planning Enforcement demolition.
3. The Ban on Flats and Maisonettes
The most common and devastating mistake clients make is assuming PDR applies to their property simply because it looks like a house. In Flats and Maisonettes, Permitted Development Rights do not exist. If your Victorian terraced house was subdivided into two flats in 1980, you have zero PDR. You must apply for full planning permission just to change a single window.
4. The Conservation Area Restriction
If your house is located within an LBHF Conservation Area, your PDR is severely curtailed. While you might still be able to build a small, single-storey rear extension under PDR, you absolutely cannot build a side-return extension, cladding, or a front roof extension without formal planning permission.
5. The Danger of Prior Approval
The government recently introduced "Larger Home Extension" PDR, allowing properties to extend up to 6 meters deep without formal planning. However, this is a trap. You must still undergo a "Prior Approval" process. LBHF planners will write to your neighbors. If a neighbor objects, the council can block the "permitted" development, effectively turning it back into a subjective planning debate.
