An appeal removes the decision-making power entirely from the LBHF Planning Directorate. The case is handed to an independent, highly trained, brutal, and technically minded Government Planning Inspector. The Inspector does not care about local ward politics or angry neighbors; they care exclusively about the mathematical interpretation of the Local Plan and national framework.
3. The Householder Appeal Process
For standard residential extensions, we utilize the "Householder Appeals Service" (HAS). The appeal is conducted entirely in writing. We draft a ferocious "Statement of Case" dismantling the council's reasons for refusal—for instance, proving the Conservation Officer overstepped their aesthetic authority regarding a rear dormer.
4. The Hearing and The Inquiry
For massive, highly complex projects—such as controversial basement evacuations facing militant opposition infrastructure—the appeal might escalate to an "Informal Hearing" or a "Public Inquiry." These are terrifying, quasi-judicial arenas where our lawyers and expert witnesses physically cross-examine the council's planners and the objecting neighbors' hired acoustic consultants in front of the Inspector.
5. The Cost and Timeline Reality
Appealing is the nuclear option. While we win a significant percentage of appeals against stubborn councils, the timeline is agonizing. The Planning Inspectorate is massively backlogged. Securing a written decision routinely takes 4 to 8 months. During that time, the £3M property sits empty, bleeding bridging finance interest, making an appeal a highly fraught financial calculation.
