1. The Conditional Victory

Clients are frequently ecstatic when our Planning Directorate informs them that the London Borough of Hammersmith & Fulham (LBHF) has granted planning permission for their Full Refurbishment. However, that "Approval" document is inevitably attached to a brutal list of "Planning Conditions."

2. "Prior to Commencement" Chaos

The most dangerous conditions are labelled "Prior to Commencement." This means it is a criminal offense to even erect scaffolding or deploy an excavator on site until you have formally satisfied these specific conditions with the Planning department in writing. Discharging these conditions takes a further 8 weeks minimum, effectively delaying the start of the build by two months after you won permission.

3. Material Samples and the Conservation Officer

The most common condition in a Conservation Area dictates that no construction can begin until physical samples of the proposed new brickwork, roof slates, and window profiles are inspected and signed off by the Conservation Officer. Our Architecture team must frequently construct a physical "sample panel" of brickwork in the garden for the officer to inspect the specific mortar jointing technique.

4. The CTMP Discharge

If you are building a Basement, you will have a condition demanding the discharge of a Construction Traffic Management Plan (CTMP). You cannot begin demolition until LBHF Highways has formally agreed to the exact GPS routing of your muck-away lorries. Negotiating this with terrified neighbors actively resisting the logistics can stall a project for an entire quarter.

5. The Breach of Condition Notice

If a rogue builder ignores the conditions and starts excavating anyway to save time, LBHF Planning Enforcement will immediately drop a "Breach of Condition Notice" (BCN) on the site. There is no legal right of appeal against a BCN. It freezes the site instantly, inflaming tensions with the council and guaranteeing a hostile relationship with the officers inspecting your project moving forward.
